Minutes of Regular Meeting
February 2, 2010

Mayor Thomas F. Jones called the Regular Meeting to order on February 2, 2010 at 7:00 pm. The pledge of Allegiance was recited. Present on roll call were Gary Wise, Harold Ellinger Jr., Pat Timmons, Robert Ostendorf, Gary Law, William Dees and Gene Cailey. Absent was Marilyn Sisson

Mayor Jones recognized Police Chief Wilkinson and Fire Chief Weber who presented Heroism Awards to:

Kathy Loyd
Ronald Loyd
Robert C. Smith
Matthew Stoneburner
Tyler Stoneburner
These people assisted in the Lake Lou Boat accident in July 2009 and helped rescue 3 people. Travis Slemploski lost his life in this accident.

Consent Agenda

A motion was made by Alderman Timmons, seconded by Alderman Ellinger to approve the following items on the consent agenda:
Reading of Minutes
Report of City Clerk
Authorization to Transfer Funds and to Pay Bills
A motion to approve the Downtown Façade Grant application submitted by Hair 51 owner, Laura Smith for the property located at 209 North State Street for an amount not to exceed $2,113.31 with final approval from the Building Inspector on materials and colors used.
A motion to approve a Resolution to Support the Historic Route 66 Recreational Trail in Macoupin and Montgomery Counties in Illinois.
A motion to approve an ordinance with the proposed fee structure for the 2010 Lake Yaeger boating season. (2nd Reading)
The Mayor directed the City Clerk to call the roll on the consent agenda which resulted in the following:
Ayes: Aldermen Wise, Timmons, Ellinger, Law, Ostendorf, Dees and Cailey

Absent: Alderwoman Sisson

Old Business:
Alderman Timmons made a motion, seconded by Alderman Dees to approve the City of Litchfield to pay the 12 cent increase per hour for each City of Litchfield employee participating in the Central Laborer's Pension Fund. This includes Management and Labor. The amount would be an additional cost of $10,800 per year. Alderman Cailey asked to table the motion and move this item to the April 6, 2010 Council meeting. Gary Wise seconded the motion. The Mayor directed a voice vote on the tabling the motion until the April 6 meeting, motion carried.

Alderman Timmons made a motion, seconded by Alderman Dees to renew membership with the Montgomery County Economic Development Corporation (MCEDC) for a one year period for a cost of $6,815 and to authorize the City Clerk to cut a check. The Mayor direct a voice vote on the motion, motion carried.

Alderman Timmons made a motion, seconded by Alderman Cailey to adopt an Ordinance amending the Zoning Ordinance of the City of Litchfield, adopted March 4, 1999, and known as Ordinance #2831, to allow "church" as a permitted special use in a district zoned "C-2" Community Business. (1st Reading)

Alderman Timmons made a motion, seconded by Alderman Cailey to adopt an Ordinance amending the Zoning Ordinance of the City of Litchfield, adopted March 4, 1999, and known as Ordinance #2831, to allow "church" as a permitted special use in a district zoned "C-2" Community Business. (2nd Reading)

Alderman Timmons made a motion, seconded by Alderman Cailey to adopt an Ordinance granting a special use permit to Latter Rain Ministries, Inc., to allow a church to be located at 1200 E. Union Ave., Litchfield, Illinois, commonly known as Sunshine Park with a legal description as described in attached Exhibit A. (1st Reading)

The Mayor directed the City Clerk to call the roll which resulted in the following:
Ayes: Aldermen Wise, Timmons, Ellinger, Law, Dees and Cailey, Ostendorf
Nays: none
Absent: Alderwoman Sisson

Alderman Timmons made a motion, seconded by Alderman Cailey to adopt an Ordinance granting a special use permit to Latter Rain Ministries, Inc., to allow a church to be located at 1200 E. Alderman Timmons made a motion, seconded by Alderman Dees to approve pay request #2 in the amount of $46,018 to S&S Excavating and Demolition for the old water plant demolition.

The Mayor direct a voice vote on the motion, motion carried.

Alderman Timmons made a motion, seconded by Alderman Dees to authorize the City Clerk to write a check to Prairieland Development, LLC, in an amount not to
exceed $506,468.46 for their annual TIF reimbursement upon receipt of authorization from the County Clerk and TIF Counsel.

The Mayor directed the City Clerk to call the roll which resulted in the following:
Ayes: Aldermen Wise, Timmons, Ellinger, Law, Ostendorf, Dees and Cailey
Nays: None
Absent: Alderwoman Sisson

Mayor Jones called for a motion to enter into Executive Session, as allowed under the Illinois Open Meetings Act, as found in Chapter 5 of the Illinois Compiled Statutes, Section 120, to address these certain and restricted items:

a. Litigation(5ILCS 120/2©(11))

Alderman Timmons made a motion, seconded by Alderman Ostendorf to enter into Executive Session. The Mayor directed for a voice vote, motion carried. Council entered into Executive Session at 7:17 pm

At completion of Executive Session, Alderman Ellinger, seconded by Alderman Ostendorf made a motion to adjourn the regular meeting. The Mayor directed a voice vote, motion carried, meeting adjourned at 8:03 pm.
